Unitary Bid Process - Judicial Review

In accordance with the Shrewsbury and Atcham Borough Council decision on 23 January 2007, and following the Government's announcement on 27 March 2007, the Council has commenced the judicial review of the Secretary of State's decision to continue with consultation over the proposed abolition of Shropshire County Council and the five district councils in Shropshire and their replacement with a unitary local authority.
Prior to commencing legal action, the Council sought independent Queen's Counsel legal opinion on the legality of the Secretary of State's action. The timetable for judicial review is limited in accordance with statutory procedures and therefore it is necessary to progress now with the judicial review process. A letter before action has been issued to the Department of Communities and Local Government (a copy of which is enclosed). In the event of the Secretary of State not acceding to the letter before action, formal proceedings will be commenced within the next two weeks.
