5.  PLANNING APPEALS

The following decisions of the Planning Inspectorate have been received by the Council regarding appeals against a decision to refuse to grant planning permission:

Site: 31 Harley Road, Cressage. Ref. 07/1396/F

Proposal: Appeal against refusal to grant planning permission for snooker room.

Decision: Appeal dismissed 18th May 2008.

Summary: The Inspector considered the proposal would be detrimental to the amenities of neighbouring land users, contrary to Local Plan Policy GP1. He considered the proposal would be unduly obtrusive and overbearing to the neighbouring residential property and it would be very difficult to mitigate the impact.

Site: 10 The Grove, Minsterley. Ref. 07/1399/F

Proposal: Appeal against refusal to grant planning permission for erection of two bedroomed dwelling house attached to 10 The Grove.

Decision: Appeal allowed 19th May 2008.

Summary: The Inspector considered the two main issues were the effect of the proposal on the character and appearance of the locality and the effect on neighbouring residents in terms of outlook and levels of natural light. The Inspector considered that the design was appropriate and the gardens of acceptable size and the proposal would not unacceptably reduce the standard of living conditions enjoyed by neighbours in terms of natural light levels and outlook. Recommended for approval by Officers.

Site: 72-74 Belle Vue Road, Shrewsbury. Ref. 07/1538/F

Proposal: Appeal against refusal to grant planning permission for change of use of shop to two flats and conversion of existing flat to two flats.

Decision: Appeal dismissed 29th May 2008.

Summary: The Inspector considered the main issue was that the rear access to the two first floor flats would lead to a considerable increase in comings and goings at the rear of the properties. The proposed path was close to the rear doors and windows of the houses and severs the gardens. This would lead to an increase in disturbance and loss of privacy to the rear of the properties and would be harmful to residential amenity. Recommended for approval by Officers.
