22/08 UNIT 26 PRIDE HILL, SHREWSBURY
Consideration was given to a report of the Senior Solicitor in respect of the change of use from A1 (non food retail) to A4 (drinking establishment) at Unit 26 Pride Hill, Shrewsbury.Councillor S J Williams spoke on behalf of Councillor Wagner and himself in accordance with the Council's scheme for public speaking on planning applications.
RESOLVED:
a) That the proposal as made by the Planning Services Manager in his report to the Development Control and Environmental Protection Committee on 4th March 2008 be accepted in accordance with the conditions previously approved by the Committee but without a S106 agreement.
b) That Officers, in consultation with the Chairman of the Development Control and Environmental Protection Committee, request that the applicant contribute a sum of money towards the funding of the Council's town centre CCTV system and that this money be ring fenced for use specifically in the area.
23/08 CONSULTATION ON VALIDATION CHECKLIST PROCEDURES
Consideration was given to a report of the Planning Services Manager in respect of the consultation on validation checklist procedures.
RESOLVED:
That the amended validation checklists for Shropshire be adopted and the new scheme be implemented as required from 6th April 2008.
24//08 DEVELOPMENT CONTROL INTERIM SCHEME OF DELEGATION
Consideration was given to a report of the Planning Services Manager in respect of the Development Control Interim Scheme of Delegation.
The Head of Development Control advised members that paragraph 11 of Appendix A needed to be deleted as it was a typing error.
Councillor Nutting spoke in accordance with the Council's scheme for public speaking on planning applications.
RESOLVED:
a) That the wording in paragraph 3 of Appendix A of the Planning Services Manager's report be amended to read "A Town or Parish Council, an organisation listed in Appendix 5 in the Council's Statement of Community Involvement or a recognised Residents Association submits a representation contrary to the officer recommendation and this is supported with reasons such as planning policy or other material considerations".
b) That, subject to the amendment set out in (a) above, the scheme of delegation as set out in Appendix A of the Planning Services Manager's report be recommended to the Standards Committee for approval.

APPLICATIONS FOR DEVELOPMENTThe Planning Services Manager submitted a schedule of applications for development with his recommendations detailed thereon. In addition to the objections and representations detailed on the schedule, the Committee also considered further schedules of additional objections/representations received, copies of which are attached to the signed minutes, which were circulated at the meeting.
Members had made visits to the following sites prior to the start of the meeting:

- Hollowdene, Drury Lane, Withington, Shrewsbury;
- Garden of 27 Kenton Drive, Shrewsbury;

- Land at, 1 Red Barn Lane, Shrewsbury.

RESOLVED:
That, subject to the amendments set out below, the recommendations of the Planning Services Manager, as contained in the Schedule of Applications (a copy of which is attached to the signed minutes), be approved:
Item 1: 08/0222/F - Land adj. to The Smithy, Acton Burnell, Shrewsbury
Include the following amendment:
Amended plans received relating to the design of the house which more accurately reflected some of the local detailing of the area and also included a splayed access at the front of the house.
The Development Control and Environmental Protection Committee determined that the application be delegated to the Planning Services Manager for approval subject to comments being received from Shropshire County Council Highways on the amended plans.
Include the following condition:
The development shall only be occupied as a Class C3 dwelling house and, not withstanding the provisions of the Use Classes Order 1987 (As Amended), shall not be occupied by students of Concord College.
Reason: To retain the residential character of the locality.
Item 3: 08/0136/LB - 6 Frodesley Hall Farm Barns, Frodesley, Shrewsbury
Application withdrawn.
Item 12: 08/0170/F - 123 Hereford Road, Shrewsbury
The Development Control and Environmental Protection Committee determined that the application be approved for the following reason:
Z102I it was considered that on the basis of the nature of the use and hours / days of operation there would be no loss of amenity to neighbours nor unacceptable harm to highway safety and hence accorded with Council's adopted policies.
Include the following conditions and informative:
Conditions relating to hours of opening / days of operation and odour control; G01; G10I (unreferenced plans received 8th and 18th February 2008).

26/08 PLANNING APPEALS
Consideration was given to the appeal decisions by the Planning Inspectorate in respect of the following sites which had been received by the Planning Services Manager.
a) 4 Heathfield Close, Shrewsbury Appeal against refusal to grant planning permission for the retention of unauthorised detached wooden storage building Ref: 07/0968/F appeal dismissed 28th February 2008.
b) 61 Windermere Road, Shrewsbury Appeal against refusal of planning permission for a first floor extension Ref: 07/1024/F appeal dismissed 26th February 2008.
c) 4 Reabrook Avenue, Shrewsbury Appeal against refusal to grant planning permission for two detached properties in the garden of No 4 Ref: 07/1226/F appeal dismissed 26th February 2008.
d) 2 Longbridge Close, Monkmoor, Shrewsbury Appeal against refusal to grant planning permission for one 2-bed detached 2-storey dwelling plus access on garden of No 2 Ref: 07/0905/F appeal dismissed 26th February 2008.
e) Land off Warrenby Close, Shrewsbury Appeal against refusal to grant planning permission for three detached chalet bungalows, including means of access Ref: 07/0706/O appeal allowed 21st February 2008.
RESOLVED:
That the decisions in respect of the above appeals be noted.
27/08 EXEMPT ITEM
RESOLVED:
That under Section 100A(4) of the Local Government Act 1972, the public be excluded from the meeting during consideration of the remaining item on the grounds that it could involve the disclosure of exempt information as defined in Paragraph 3 of Part 1 of Schedule 12A of the Act.
28/08 NEW STREET NURSERY
(The Chairman indicated that she had agreed that this matter should be considered as a matter of urgency in the interests of Health and Safety).Consideration was given to the points raised by a member of the Committee in relation to New Street Nursery.
RESOLVED:
That the discussion in relation to New Street Nursery be noted.
