Development Control and Environmental Protection Committee

Meeting to be held in the Council Chamber, The Guildhall, Frankwell Quay, Shrewsbury on Tuesday, 1st April 2008 at 5.30 p.m.

Site Visits from The Guildhall at 10.00 a.m. (Light refreshments will be provided for Members and Officers in the Staff Room from 5.00 p.m.)

Members are respectfully reminded of the following planning procedure adopted by the Council:

1.  The Development Control and Environmental Protection Committee will refer to the Planning Committee for determination:

a)   any proposed refusal of deemed planning permission or the reference back to the Cabinet of a decision to seek planning permission;

b)   and with reasons, any application for planning permission where the Committee is minded to approve the application contrary to the officer's recommendation and where, if approved, the application would be a significant departure from the policies of the development plan.

c)   any controversial application which this committee has failed to determine.

2.  That in the event of the Development Control and Environmental Protection Committee recommending the determination of an application for planning permission contrary to a development plan then the reason for so doing shall be minuted.

3.  That where the Development Control and Environmental Protection Committee is minded to refuse an application for planning permission contrary to the officers recommendation then:

a)   the Committee shall specify as fully as possible the proposed grounds for refusal;

b)   the Solicitor in conjunction with the Planning Services Manager shall be asked to consider whether any of the grounds for refusal are lawful and sustainable;

c)   if one or more grounds for refusal are lawful and sustainable the application shall be refused on the grounds stated;

d)   if none of the grounds are considered to be lawful and sustainable, the application shall be referred back to the Committee for determination at the next meeting with a report from the Solicitor.

4. That all correspondence received by members on current or forthcoming planning applications be forwarded to the Planning Department for details to be included in the officers' report or schedule of additional letters before return to members.

That the Minutes of the meeting of the Development Control and Environmental Protection Committee held on 4th March 2008 be confirmed as a correct record and be signed by the Chairman.

Recommendation:

That the Council adopt the proposed amended validation checklists for Shropshire and implement the new scheme as required from the 6th April 2008.

 

6. DEVELOPMENT CONTROL – INTERIM SCHEME OF DELEGATION

Recommendation:

That the scheme of delegation set out in Appendix A be recommended to the Standards Committee for approval.

 

7.   APPLICATIONS FOR DEVELOPMENT

To consider the schedule of applications for development submitted by the Planning Services Manager.

The Chairman will propose that with regard to applications on the schedule of applications for development submitted by the Planning Services Manager on which there is no debate, the recommendations of the Officers be deemed to have been accepted without any modifications.

 

8.   PLANNING APPEALS

The following decisions of the Planning Inspectorate have been received by the Council regarding appeals against a decision to refuse to grant planning permission:

Site: 4 Heathfield Close, Shrewsbury. Ref. 07/0968/F

Proposal: Appeal against refusal to grant planning permission for the retention of unauthorised detached wooden storage building.

Decision: Appeal dismissed 28th February 2008.

Summary: The appeal concerned a garden shed within the property curtilage. The Inspector considered that the position in front of the property was unsatisfactory and effected the character and appearance of the area. Allowing the appeal could also lead to proposals for similar unsatisfactory development.

 

Site: 61 Windermere Road, Shrewsbury. Ref. 07/1024/F

Proposal: Appeal against refusal of planning permission for a first floor extension.

Decision: Appeal dismissed 26th February 2008.

Summary: The Inspector considered the main issue was the impact of the proposal on the amenity of neighbouring residents with particular regard to exposure to daylight and to their outlook. It was considered that the proposal would have an unacceptable impact on the neighbouring property.

 

Site: 4 Reabrook Avenue, Shrewsbury. Ref. 07/1226/F

Proposal: Appeal against refusal to grant planning permission for two detached properties in the garden of No 4.

Decision: Appeal dismissed 26th February 2008.

Summary: The Inspector considered the main issues were impact on the living conditions of the occupiers of the proposed and existing dwellings with regard to privacy, outlook, noise and disturbance. The proposed bungalow to the rear would have a dark, cramped and confined location and the car parking and access arrangements would also lead to a great deal of noise and disturbance for occupiers in the associated properties. The site was too small for the development proposed.

 

Site: 2 Longbridge Close, Monkmoor, Shrewsbury. Ref. 07/0905/F

Proposal: Appeal against refusal to grant planning permission for one 2-bed detached 2-storey dwelling plus access on garden of No 2.

Decision: Appeal dismissed 26th February 2008.

Summary: The Inspector considered the main issues were the impact on the character and appearance of the locality. The proposal would result in a poorly located side garden and a prominent fence. Recommended for approval by Officers.

 

Site: Land off Warrenby Close, Shrewsbury. Ref. 07/0706/O

Proposal: Appeal against refusal to grant planning permission for three detached chalet bungalows, including means of access.

Decision: Appeal allowed 21st February 2008.

Summary: The Inspector considered that the main issues were the effects on neighbours' living conditions and the adjacent green space and wildlife habitat. He considered that the site could accommodate the development without detriment to neighbours' living conditions, particularly given that the dwellings were to be bungalows. The site was capable of accommodating the development and would not impact on the adjoining green space. Access was also acceptable and flooding was not an issue of concern. Recommended for approval by Officers.
