PLEASURE BOARTS AND VESSELS ON THE RIVER SEVERN

Made under Section 172 of the Public Health Act 1875 by the Mayor, Aldermen and Burgesses of the Borough of Shrewsbury acting by Shrewsbury and Atcham Borough Council


INTERPRETATION

1. Throughout these byelaws:-

 "The Corporation" means the Mayor, Aldermen and Burgesses of the Borough of Shrewsbury acting by the Shrewsbury Borough Council.
 "The River" includes so much of the River Severn as lies within the Borough of Shrewsbury.

REGULATION OF PLEASURE BOATS

For regulating the numbering and naming of pleasure boats and vessels.
2. Every proprietor of a pleasure boar or vessel shall:-
(a) cause the number of any licence granted by the Corporation in respect of the boat or vessel to be painted or marked conspicuously on the exterior of each bow;
(b) unless it is painted or marked thereon in pursuance of any other legal requirement, cause the name of the boat or vessel as specified in any licence granted by the Corporation in respect thereof to be painted or marked conspicuously in the interior thereof;
(c) cause the number or name required to be painted or marked under the foregoing provisions of this Byelaw to be kept plainly and distinctly visible and legible at all times while the boat or vessel may ply or be used for hire.

For regulating the number of persons to be carried in pleasure boats and vessels.
3. The proprietor or boatman or other person in charge of a pleasure boat or vessel shall not while the same is plying or used for hire, allow to be carried therein a greater number of persons than can be safely carried, notwithstanding that the number which can be safely carried may be less than the number of persons specified in any licence granted by the Corporation in respect of the pleasure boat or vessel.
For securing the good and orderly conduct of boatmen or other persons while in charge of pleasure boats and vessels.
4. Every boatman or other person in charge of a pleasure boat or vessel shall while the boat or vessel is carrying any person or persons for hire exercise proper skill and care in the navigation and management thereof, and take all precautions necessary to prevent danger or discomfort to such person or persons.

5. A boatman or other person in charge of a pleasure boat or vessel shall not -
(a) importune any person to his annoyance to hire or be carried for hire in the boat or vessel;
(b) cause or suffer any incompetent person to assist in the navigation or management of the boat or vessel at any time when the boat or vessel is carrying any person for hire.

For fixing the qualification of the boatmen or other persons in charge of pleasure boats and vessels.
6. A person shall not for hire take charge of the navigation of a pleasure boat or vessel unless-
(a) he has been regularly in charge of a boat or vessel carrying members of the public for hire for at least twelve months, or
(b) he has been an apprentice or assistant to a person having the qualification referred to in the foregoing paragraph for at least twelve months and has been actually and regularly engaged in the navigation of a boat or vessel carrying members of the public for hire, or
(c) he is qualified by reason of experience in the navigation of seagoing or other boats or vessels to handle the boat or vessel at least as competently as a person having the qualification referred to in the foregoing paragraph (a).

PENALTIES

7. Every person who shall offend against any of these Byelaws shall be liable on summary conviction to a fine not exceeding twenty pounds and in the case of a continuing offence to a further fine not exceeding two pounds for each day during which the offence continues after conviction therefor.

8. The Byelaw with respect to pleasure boats and vessels which were made by the Corporation on 5th April 1934 and confirmed by the Minister of Health on 20th April 1934 are hereby repealed.
