BYELAWS WITH RESPECT TO THE REGULATION OF TRAFFIC AND BOATS AND THE RATE OF SPEED OF BOATS ON THE RIVER SEVERN

BYELAWS

Made by the Mayor, Alderman and Burgesses of the Borough of Shrewsbury, acting by the Council, pursuant to sections 55 and 83 of the Shrewsbury Corporation Act 1909 (9 Edw. 7. Cap 135) and to sections 182 to 185 of The public Health Act 1875 (38 and 39 Victoria Cap.55).


Interpretation of Terms

1. In the construction of these byelaws the following terms shall have the meanings hereinafter mentioned respectively assigned to them:-

"The Corporation" means the Mayor, Alderman and Burgesses of the Borough of Shrewsbury, acting by the Council.

"The River" includes so much of the River Severn as lies within the Borough of Shrewsbury.

"Boat" means and includes all boats and vessels propelled by steam, motor or other mechanical power.

 2. The proprietor or other person in charge of a boat whether plying for hire or not shall not cause or suffer such boat to travel on any portion of the River at a greater rate of speed than eight miles an hour; he shall not cause or suffer such boat to travel on any portion of the River at a speed which shall be dangerous to the safe and convenient navigation of the River regard being had to all the circumstances of the case including the amount of traffic which is at the time on the River in the vicinity of the boat; nor shall he cause or suffer such boat to be driven recklessly or negligently or in any manner as may be likely to cause danger to life or damage or injury to moorings or the Banks of the River or other property or things.

 3.   Every person who shall offend against the foregoing Byelaw shall be liable for every such offence to a penalty of Five Pounds and in the case of a continuing offence to a further penalty of Forty Shillings for each day after written notice of the offence from the Council.
 
Provided nevertheless that the Justices or Court before whom any complaint may be made or any proceedings may be taken in respect of any such offence may, if they think fit, adjudge the payment, as a penalty, of any sum less that the full amount of the penalty imposed by this Byelaw.

 4.    The foregoing Byelaws shall come into operation on the expiration of fourteen days after the date of the confirmation thereof by the Minister of Transport
